These Terms of Use govern access to and use of SwaMiti, including its website, Articles, Tools, Calculators, Community features, downloadable resources and related services.

By using SwaMiti, you agree to use the site in accordance with these Terms and applicable law.

Where SwaMiti asks a registered user to actively accept these Terms, for example by selecting an “I agree” checkbox, that acceptance may be recorded electronically.

2. Nature and purpose of SwaMiti

SwaMiti is an independent technical knowledge, exploration and interaction project operated by an individual based in India.

It may provide:

  • technical Articles;
  • engineering Calculators and converters;
  • software Tools and designer utilities;
  • downloadable resources;
  • references and educational material;
  • Community discussions and user contributions; and
  • other technical resources introduced from time to time.

SwaMiti is not represented as an engineering consultancy, certification authority, testing laboratory or substitute for project-specific professional engineering services.

Use of technical information is also subject to the separate Technical Disclaimer.

3. Access to the site

Publicly available Articles, Calculators, Tools and other resources may generally be accessed without registration unless stated otherwise.

SwaMiti may introduce features that require an account, including Community participation, saved preferences, bookmarks, saved calculations, downloads or other enhanced functionality.

Availability of any particular feature may change over time.

4. Registered users

Registration on SwaMiti is intended only for persons 18 years of age or older.

By creating an account, a user confirms that they are at least 18 years old.

Users must:

  • provide a valid email address where required;
  • keep login credentials confidential;
  • take reasonable steps to prevent unauthorized account access;
  • promptly report suspected unauthorized use; and
  • remain responsible for activity conducted through their account, subject to applicable law.

SwaMiti does not presently require ordinary users to disclose their legal name publicly.

Users may be permitted to choose a public display name or pseudonym, subject to Community rules and restrictions against impersonation or deception.

5. Permitted use

Users may access and use SwaMiti for lawful purposes including:

  • learning and technical exploration;
  • personal or professional reference;
  • performing calculations;
  • using available software utilities;
  • participating in permitted discussions;
  • sharing links to SwaMiti content; and
  • other uses expressly supported by the site.

Use of SwaMiti does not transfer ownership of SwaMiti content, branding, software or intellectual property to the user.

6. Technical use and user responsibility

Users remain responsible for determining whether any information, calculation, Tool, software utility or other resource is appropriate for their particular circumstances.

Technical content should be independently verified where its use may influence engineering, manufacturing, construction, contractual, safety-related or other consequential decisions.

The Technical Disclaimer forms part of these Terms insofar as it relates to technical use of SwaMiti.

7. Prohibited use

Users must not knowingly use SwaMiti to:

  • violate applicable law;
  • gain unauthorized access to systems, accounts or data;
  • interfere with the security or operation of the site;
  • introduce malware, malicious code or harmful files;
  • deliberately overload or disrupt site infrastructure;
  • scrape or extract content at a scale or in a manner that materially disrupts the service;
  • impersonate another person or organization;
  • misrepresent affiliation, qualification or authority;
  • publish unlawful, threatening, abusive, fraudulent or deliberately misleading material;
  • infringe intellectual-property or other legal rights;
  • bypass technical restrictions or access controls; or
  • use Community functions for spam or unsolicited commercial promotion.

Reasonable indexing by legitimate search engines and ordinary sharing/linking are not intended to be prohibited.

8. Articles and site content

Unless otherwise stated, SwaMiti Articles and original site content are made available for reading and reference.

Users may quote limited portions with appropriate attribution for commentary, criticism, review or educational use, to the extent permitted by applicable law, and may link to public SwaMiti pages.

Users must not reproduce, republish, distribute or commercially exploit substantial portions of SwaMiti-owned content without permission where such permission is legally required.

Nothing in these Terms restricts rights that users may have under applicable copyright exceptions or other applicable law.

9. Standards and third-party material

Articles may refer to standards, specifications, publications, manufacturers, software or other third-party material.

Such references do not transfer ownership of third-party intellectual property to SwaMiti.

SwaMiti does not intend to reproduce copyrighted standards in place of their official publications.

Users should obtain authoritative copies from the relevant standards body, publisher or rights holder where required.

10. Calculators

Calculators and converters are provided as technical aids.

Their use is governed by these Terms and the Technical Disclaimer.

Users remain responsible for checking:

  • inputs;
  • units;
  • assumptions;
  • formulas where relevant;
  • displayed precision;
  • applicability to the intended use; and
  • results used in consequential decisions.

SwaMiti may change or improve calculator logic, presentation, references or supported units over time.

Where a calculator identifies assumptions, definitions or reference sources, users should consider those materials part of the calculator’s context.

11. Software tools and downloads

SwaMiti may provide software utilities, downloadable applications or other executable resources.

Specific Tools may be accompanied by:

  • documentation;
  • version information;
  • system requirements;
  • licence terms;
  • known limitations; and
  • separate end-user licence conditions.

Where separate software licence terms are provided, those terms will apply to that software in addition to these Terms.

Users should maintain appropriate backups and security procedures before using downloadable software on important data or production systems.

12. Community and user contributions

If Community features are enabled, users may be permitted to submit questions, answers, comments, discussions, files or other material.

Users remain responsible for the content they submit.

Users must not knowingly submit material that:

  • they do not have the right to share;
  • contains confidential or proprietary information without authorization;
  • infringes another person’s rights;
  • is deliberately false or deceptive;
  • contains malware or harmful content; or
  • violates applicable Community Guidelines.

Technical contributions from users should not be assumed to have been independently verified by SwaMiti.

13. User rights in submitted content

A user who uploads, posts, shares or otherwise submits content to SwaMiti represents that they have the legal right, permission or authority necessary to share that content.

Users must not submit material that:

  • belongs to another person or organization and which they do not have the right to share;
  • infringes copyright, patent, trademark, design rights, confidentiality obligations, trade secrets or other proprietary rights; or
  • contains confidential, employer-owned, customer-owned or project-restricted information without authorization.

The user remains responsible for ensuring that material they submit may lawfully be shared.

14. Third-party and user-submitted content

SwaMiti does not claim ownership of user-submitted content merely because it is hosted or displayed on the site.

SwaMiti does not guarantee that every user contribution has been independently reviewed for copyright, confidentiality, ownership or other legal rights before publication.

To the extent permitted by applicable law, responsibility for the legality and rights associated with user-submitted content remains with the user who submitted it.

If SwaMiti receives a credible complaint or valid legal notice concerning allegedly unlawful or infringing content, SwaMiti may investigate and may temporarily restrict, remove or disable access to that content as appropriate.

15. Reporting infringement or unauthorized content

A rights holder or affected person may report content believed to infringe intellectual-property, confidentiality, privacy or other legal rights.

Reports should be sent to office@swamiti.com and should, where reasonably possible, include:

  • identification of the affected content or URL;
  • the nature of the claimed right or concern;
  • enough information to explain why the content is believed to be unauthorized or unlawful;
  • the complainant’s contact information; and
  • any supporting information reasonably necessary to assess the report.

After receiving a report, SwaMiti may:

  • acknowledge receipt;
  • request further information where reasonably necessary;
  • review the reported content;
  • temporarily restrict access while the matter is reviewed where appropriate;
  • remove, restore or leave the content available depending on the circumstances; and
  • take proportionate action in cases of repeated misuse or repeated rights violations.

SwaMiti may also decline or limit action on reports that appear manifestly abusive, intentionally misleading, unsupported, or unrelated to rights that the complainant is entitled to raise, subject to applicable law.

SwaMiti aims to acknowledge reasonably complete reports within a reasonable period and to begin review as soon as reasonably practicable. Urgent or legally time-sensitive notices may be handled sooner where necessary. Where applicable law requires a particular response or removal timeline, that legal requirement will apply.

16. Licence for user-submitted content

When a user voluntarily posts content to a public Community area, the user grants SwaMiti the limited permission reasonably necessary to store, host, display, format, transmit, reproduce and technically process that content for operation of the Community and the site functionality through which it was submitted.

This does not transfer ownership of the user’s original content to SwaMiti.

If broader reuse rights are ever required, for example for publishing Community contributions as Articles, promotional material or other separately edited content, separate permission should be obtained rather than assumed under this clause.

17. Moderation

SwaMiti may moderate, restrict, edit, hide or remove Community material where reasonably necessary to:

  • enforce site rules;
  • respond to reported content;
  • protect users or site operation;
  • address legal concerns; or
  • remove spam or harmful material.

Moderation does not mean that all user-submitted content has been reviewed or technically verified.

Detailed Community Guidelines may be introduced before or when Community functionality is launched.

18. Account restriction or termination

SwaMiti may restrict or suspend an account where there is reasonable evidence of:

  • serious or repeated violation of these Terms;
  • security abuse;
  • spam;
  • impersonation;
  • unlawful activity; or
  • malicious interference with the service.

Where appropriate and practical, the user may be given notice or an opportunity to address the issue.

19. Third-party links and services

SwaMiti may contain links to third-party websites, standards bodies, publications, software or services.

Third-party services operate under their own terms and privacy practices.

SwaMiti does not control third-party services merely because a link or reference appears on the site.

20. Availability, changes and maintenance

SwaMiti may:

  • modify site functionality;
  • update Articles;
  • correct Calculators;
  • issue new Tool versions;
  • temporarily interrupt services for maintenance; or
  • discontinue features that are no longer practical or supported.

Continuous or error-free availability is not guaranteed.

Reasonable efforts may be made to preserve useful public technical content and avoid unnecessary disruption.

21. No warranties

To the extent permitted by applicable law, SwaMiti is provided on an “as available” basis.

No guarantee is made that:

  • every item of content is complete or error-free;
  • every Tool will operate in every environment;
  • every Calculator will be suitable for every application;
  • the site will always be uninterrupted; or
  • third-party links or resources will remain available.

Nothing in these Terms is intended to exclude warranties, guarantees or other rights that cannot lawfully be excluded.

22. Limitation of responsibility

Users should not rely solely on SwaMiti for consequential technical or engineering decisions.

To the extent permitted by applicable law, SwaMiti does not accept responsibility for indirect or consequential loss arising solely from reliance on site content, Calculators, Tools or Community material.

This provision must be read together with the Technical Disclaimer and does not exclude responsibility that cannot legally be excluded.

23. Privacy and cookies

Collection and use of personal information is governed by the separate Privacy Policy.

Use of cookies and browser storage is described in the separate Cookie Policy.

Users should review the relevant policies before registering, submitting personal information, or enabling optional Functional or Analytics technologies.

24. Changes to these Terms

SwaMiti may revise these Terms as the site develops or legal or operational requirements change.

The current version and its effective date should always be available on this page.

Where a material change affects registered users, SwaMiti should provide reasonable notice and, where appropriate, request renewed acceptance.

25. Governing law

These Terms are governed by the laws of India.

Subject to applicable law and to the extent jurisdiction may lawfully be agreed, the courts at Vadodara, Gujarat, India shall have exclusive jurisdiction over disputes arising from or relating to these Terms or use of SwaMiti. Nothing in this clause limits any right, remedy, forum or jurisdiction that cannot lawfully be excluded or restricted.
